ORDER ADOPTING TEMPORARY AMENDMENTS PENDING REVISION
OF RULES FOR THE OKLAHOMA COURT OF CRIMINAL APPEALS

¶1 The Committee on revisions for the Rules for the Oklahoma Court of Criminal Appeals has made certain recommendations which are pending before the Court. One of the recommendations submitted by the committee is to amend the types of cases under "Section XI Accelerated Docket Procedures" of the rules which are mandatory for placement on the Accelerated Docket. Prior to formally adopting those revisions, the Court finds it would be appropriate to have a period when the Court can evaluate the effectiveness of the recommended changes to ensure the final revision of the Rules are drafted appropriately to obtain the intended effect of the change.

¶2 IT IS THEREFORE ORDERED, ADJUDGED AND DECREED that effective March 1, 2001, Rule 11.2, Rules of the Oklahoma Court of Criminal Appeals, App.(2000), shall be temporarily amended to remove revocation of suspended sentences and appeals of the conditions of probation of an order deferring judgment, with or without an application to withdraw plea, and/or acceleration of a deferred judgment and sentence from those cases which are automatically assigned to the accelerated docket. Commencing on March 1, 2001, any appeals filed which previously have been governed by the provisions of Rule 11.2A(2) and (3) shall be filed pursuant to Section II and Section III of the Rules of the Oklahoma Court of Criminal Appeals. During this period of evaluation, those appeals shall be filed as regular appeals in accordance with the time periods and filing requirements set forth in Section II and Section III. This temporary amendment to the orders of this Court shall remain in effect until cancelled by either a subsequent order of this Court or the adoption of the planned revisions to the Court's Rules.
