To: Mr. Andy Payne, Clerk of the Supreme Court and the Court of

Criminal Appeals., State of Oklahoma.

¶1 The Clerk is hereby directed to refrain from filing Applications or Petitions for Rehearing on Writs of Mandamus, Habeas Corpus, Prohibition, or any other original proceeding in which the Court has rendered an opinion unless authorized by the Rules of the Court; or permission to file same has been granted in writing by a member of said Court; or, the Court on its own motion has directed the recall of said opinion; and,

¶2 The Clerk is specifically directed to withdraw and strike from the records of the Court the purported "Application for rehearing" in A-13,335 Smith v. State, 381 P.2d 900, the failing of same being neither authorized by the Rules of this Court, nor by one of the Judges thereof.

¶3 The Clerk is further directed to forward a certified copy of this order to the District Court of Mayes County and to Thomas Landrum, County Attorney of Mayes County.

¶4 WITNESS my hand and the Seal of this Court on this the 17th day of July, 1963.
