opinion as provided by section 3172, Stat. 1931, in the matter of the conviction of Luke Nichols for the crime of murder in the district court of Alfalfa county on the 1st day of August, 1932, and by judgment of said court sentenced on the 4th day of August, 1932, to death by electrocution on October 28, 1932, we hereby submit the following opinion of the judges:
