Borchert v. ENTRY OF DISMISSAL KENT STATE UNIVERSITY Defendant {¶ 1} On April 2, 2008, plaintiff, Jenai Simon, filed a complaint against defendant, Kent State University. Plaintiff did not submit the filing fee or a poverty statement with the complaint. On April 7, 2008, this court issued a notice to pay filing fee. The notice stated in pertinent part: Your case may be dismissed unless the required filing fee is paid or a poverty statement is filed on or before May 7, 2008. {¶ 2} On May 15, 2008, defendant filed a motion to dismiss based on the failure of plaintiff to comply with this court s notice. A review of the docket reveals plaintiff has not submitted the filing fee or the poverty statement. Upon review, the court finds the defendant s motion to dismiss is GRANTED. Plaintiff s case is DISMISSED without prejudice. The court shall absorb the court costs of this case. ________________________________ DANIEL R.
