Barwell Lloyd Pierre-Louis Applicant : : ORDER OF A THREECOMMISSIONER PANEL : : : : : {¶1} : The applicant filed a reparations application seeking reimbursement of expenses incurred with respect to a June 7, 2006 sexual assault and kidnaping incident. On August 3, 2006, the Attorney General granted the applicant an award totaling $25.00 for evidence replacement loss, however the award was not paid pursuant to R.C. 2743.191 because the sum does not exceed $50.00. The Attorney General denied the claim for work loss pursuant to R.C. 2743.52(A) and denied the claim for allowable expense pursuant to R.C. 2743.60(D). On September 1, 2006, the applicant filed a request for reconsideration. On October 31, 2006, the Attorney General determined that the previous decision warranted no modification. On November 29, 2006, the applicant filed a notice of appeal to the Attorney General s October 31, 2006 Final Decision. On February 21, 2007 at 11:30 A.M., this matter was heard before this panel of three commissioners. Case No. V2006-21131 {¶2} -1- ORDER Neither the applicant nor anyone on her behalf appeared at the hearing. An Assistant Attorney General attended the hearing and presented comments for the panel s consideration. The Assistant Attorney General briefly summarized the case and reiterated her position for denying the claim. {¶3} From review of the file and with full and careful consideration given to all the information presented at the hearing, we find the October 31, 2006 decision of the Attorney General shall be affirmed. {¶4} IT IS THEREFORE ORDERED THAT: {¶5} 1) The October 31, 2006 decision of the Attorney General is {¶6} 2) This claim is DENIED and judgment is rendered for the state; {¶7} 3) This order is entered without prejudice to the applicant s right to file a AFFIRMED; supplemental compensation application, within five years of this order, pursuant to R.C. 2743.68; {¶8} 4) Costs are assumed by the court of claims victims of crime fund. _______________________________________ RANDI OSTRY LE HOTY Presiding Commissioner _______________________________________ GREGORY P.
