Borchert v. ENTRY OF DISMISSAL OHIO DOT DIST. 9 Defendant {ΒΆ1} On December 11, 2006, plaintiff entity filed a complaint against defendant, Department of Transportation. On December 14, 2006, this court issued an entry ordering plaintiff entity to obtain counsel to proceed with this claim, to file a notice of appearance, and an amended complaint with this court. Plaintiff entity was also ordered to submit the $25.00 filing fee or a poverty statement. Plaintiff entity has not complied with the court s orders. Therefore, plaintiff s case is dismissed, without prejudice, pursuant to Civ.R. 41. The court shall absorb the costs of this case.
