ROUNDTREE : ORDER OF A THREECOMMISSIONER PANEL Applicant : : : : : : {¶1} The applicant filed a reparations application seeking reimbursement of legal expenses incurred with respect to an August 8, 2003 through November 18, 2005 littering incident on his property. On March 27, 2006, the Attorney General denied the claim pursuant to R.C. 2743.52(A) contending that the applicant failed to prove that he was a victim of criminally injurious conduct or that he incurred economic loss as a result of criminally injurious conduct. On May 18, 2006, the applicant filed a request for reconsideration. On June 5, 2006, the Attorney General denied the claim once again. On June 16, 2006, the applicant filed a notice of appeal to the Attorney General s June 5, 2006 Final Decision. Hence, this matter came to be heard before this panel of three commissioners on September 7, 2006 at 10:30 A.M. {¶2} Neither the applicant nor anyone on his behalf appeared at the hearing. An Assistant Attorney General attended the hearing and presented brief comments for the panel s consideration. The Assistant Attorney General summarized the facts of the Case No. V2006-20534 -1- ORDER case and reiterated her position for denying the claim pursuant to R.C. 2743.52(A). After a brief discussion of the claim, the panel chairman concluded the hearing. {¶3} From review of the file and with full and careful consideration given to all the information presented at the hearing, we find the June 5, 2006 decision of the Attorney General shall be affirmed. IT IS THEREFORE ORDERED THAT 1) The June 5, 2006 decision of the Attorney General is AFFIRMED; 2) This claim is DENIED and judgment is rendered for the state of Ohio; 3) Costs are assumed by the court of claims victims of crime fund. _______________________________________ THOMAS H.
