PIERCE : ORDER OF A THREECOMMISSIONER PANEL Applicant : : : : : : {¶ 1} The applicant filed a reparations application seeking reimbursement of economic loss incurred with respect to a February 15, 2006 assault incident. On March 28, 2006, the Attorney General denied the claim pursuant to R.C. 2743.60(E) because the applicant had been convicted of felony possession of cocaine on December 24, 2002, which is within ten years of the criminally injurious conduct. On April 5, 2006, the applicant filed a request for reconsideration. On April 11, 2006, the Attorney General determined that the previous decision warranted no modification in light of the applicant s felony conviction. On May 9, 2006, the applicant filed a notice of appeal to the Attorney General s April 11, 2006 Final Decision. Hence, the matter was heard before this panel of three commissioners on August 10, 2006 at 10:15 A.M. {¶ 2} Neither the applicant nor anyone on her behalf appeared at the hearing. An Assistant Attorney General attended the hearing and presented an exhibit and Case No. V2006-20381 -1- ORDER reiterated her position to deny the claim pursuant to R.C. 2743.60(E). After a brief discussion of the claim, the panel chairman concluded the hearing. {¶ 3} From review of the file and with full and careful consideration given to all the information presented at the hearing, we find the April 11, 2006 decision of the Attorney General shall be affirmed. IT IS THEREFORE ORDERED THAT 1) The April 11, 2006 decision of the Attorney General is AFFIRMED; 2) This claim is DENIED and judgment is rendered for the state of Ohio; 3) Costs are assumed by the court of claims victims of crime fund. _______________________________________ LLOYD PIERRE-LOUIS Commissioner _______________________________________ THOMAS H.
