{¶ 1} On May 8, 2006, defendant filed a motion for summary
judgment.
The
magistrate
issued
a
decision
recommending
defendant’s motion be denied.
{¶ 2} Upon review of the record, the court determines that there
is no error of law or other defect on the face of the magistrate’s
decision.
Therefore, the court adopts the magistrate’s decision
