PARSONS : ORDER OF A THREECOMMISSIONER PANEL Applicant : : : : : : {¶ 1} On October 30, 2003, the applicant filed a reparations application seeking reimbursement of expenses incurred with respect to an alleged August 7, 2001 incident. On February 27, 2004, the Attorney General denied the applicant s claim pursuant to R.C. 2743.52(A), R.C. 2743.56(B), and R.C. 2743.60(A). The Attorney General stated that the applicant failed to prove he was a victim of criminally injurious conduct, that he failed to file a timely reparations application (within two years of the alleged criminally injurious conduct), and that he failed to report the alleged incident to law enforcement officials. On March 3, 2004, the applicant filed a request for reconsideration. On May 3, 2004, the Attorney General denied the claim once again. On May 5, 2004, the applicant filed a notice of appeal to the Attorney General s May 3, 2004 Final Decision. Hence, this matter came to be heard before this panel of three commissioners on July 21, 2004 at 1:15 P.M. {¶ 2} Neither the applicant nor anyone on his behalf appeared at the hearing. An Assistant Attorney General attended the hearing and stated that she rests on her Statement in Lieu of Brief. Case No. V2004-60458 -1- ORDER {¶ 3} From review of the file and with full and careful consideration given to all the information presented at the hearing, we find that the May 3, 2004 decision of the Attorney General shall be affirmed. IT IS THEREFORE ORDERED THAT 1) The May 3, 2004 decision of the Attorney General is AFFIRMED; 2) This claim is DENIED and judgment is rendered in favor of the state of Ohio; 3) Costs are assumed by the court of claims victims of crime fund. _______________________________________ CLARK B.
