On August 11, 2003, the Attorney General denied the applicant’s claim pursuant to R.C. 2743.56(B) and R.C. 2743.60(A) contending that the applicant failed to file a reparations application within two-years of the criminally injurious conduct. On August 18, 2003, the applicant filed a request for reconsideration. On February 17, 2004, the Attorney General denied the applicant’s claim for an award of reparations once again. On March 18, 2004, the applicant filed a notice of appeal to the Attorney General’s February 17, 2004 Final Decision asserting that he was unable to file a timely reparations application because he is illiterate. Mr. Totton briefly testified that he was unaware of the filing deadline. Nevertheless, the Assistant Attorney General stated that the claim must be denied in light of the untimely filing of the reparations application.
