On September 30, 2004, plaintiff was granted an additional 30 days to file an amended complaint. A review of the docket reveals plaintiff has not complied with this court s order. Therefore, plaintiff s action is DISMISSED, without prejudice, pursuant to Civ.R. 41. The court shall absorb the costs of this case.
