IN THE COURT OF CLAIMS OF OHIO
VICTIMS OF CRIME DIVISION
IN RE: TRISHA S. KINDLE
:
Case No. V2003-40615
CAROLYN S. KINDLE
:
ORDER OF A THREECOMMISSIONER PANEL
Applicant
:
: : : :
:
{¶1} This appeal came to be heard before this panel of three commissioners on
September 11, 2003 at 10:35 A.M. upon the applicant’s June 19, 2003 appeal from the June 12,
2003 Final Decision of the Attorney General.
{¶2} The applicant filed a reparations application seeking reimbursement for expenses
incurred in an alleged February 6, 2003 incident involving her daughter. The applicant asserted
that her minor daughter, Trisha, was a victim of criminally injurious conduct because she was
influenced to leave home by a male friend. The applicant contended that her daughter’s male
friend committed the crimes of contributing to the delinquency of a minor and interfering with
custody. The Attorney General denied the claim contending that Trisha does not qualify as a
victim of criminally injurious conduct. The applicant appealed the Attorney General’s Final
Decision.
{¶3} The applicant, applicant’s attorney and an Assistant Attorney General attended the
hearing.
This case and Case Number V2003-40607, the applicant’s personal claim, were
Case No. V2003-40615
consolidated for hearing purposes.
-1-
ORDER
However, the applicant’s testimony and oral argument
presented concerned V2003-40607 and not the present case.
{¶4} From review of the file and with full and careful consideration given to all the
information presented at the hearing, we find the June 12, 2003 decision of the Attorney General
shall be affirmed.
{¶5} IT IS THEREFORE ORDERED THAT
{¶6} 2) The June 12, 2003 decision of the Attorney General is AFFIRMED;
{¶7} 3) This claim is DENIED and judgment is entered for the state of Ohio;
{¶8} 4) Costs are assumed by the court of claims victims of crime fund.
