OF TRANSPORTATION Defendant : ::::::::::::::::: {¶1} On April 25, 2003, this court issued a notice to plaintiff to either pay the $25 filing fee or to file a poverty statement with supporting documentation. Plaintiff has failed to file the filing fee or poverty statement. Therefore, plaintiff s action is DISMISSED, without prejudice, pursuant to Civ.R. 41(B)(1). The court shall absorb the costs of this case. The clerk shall serve upon all parties notice of this judgment and its date of entry upon the journal. {¶2} On July 14, 2003, a judge of the Court of Claims issued an entry which reinstated plaintiff s case and remanded the case to the clerk.
