On April 24, 2003, defendant filed a motion to dismiss based on plaintiff s failure to submit the filing fee or a poverty statement. In the alternative, defendant filed a motion to extent time if the motion to dismiss is not granted. Plaintiff has failed to comply with the court s notice. {¶2} Defendant s motion to dismiss is GRANTED and plaintiff s case is DISMISSED without prejudice. Defendant s motion to extend time is MOOT.
