On March 27, 2003, plaintiff was granted an extension of time to submit the filing fee. Plaintiff was ordered to pay the filing fee on or before April 21, 2003. Plaintiff has failed to comply with the court order. {¶2} On May 22, 2003, defendant filed a motion for leave to file instanter and the investigation report. {¶3} Therefore, defendant's motion is MOOT and plaintiff's action is DISMISSED, without prejudice, pursuant to Civ.R. 41(B)(1).
