Per Curiam.

[¶1] Gerald Schmidt appealed eleven orders of the district court concerning the Estate of Odelia Schmidt, including an order approving final account and distribution and determining testacy status, and an order approving purchase of real estate. Three prior appeals by Gerald Schmidt concerning the Estate of Odelia Schmidt, disposed of many of the issues raised in this appeal. Estate of Schmidt, 1997 ND 244, 572 N.W.2d 430; Schmidt v. Schmidt, 1997 ND 44, 560 N.W.2d 886; Schmidt v. Schmidt, 540 N.W.2d 605 (N.D. 1995). We conclude this appeal is frivolous and completely without merit; therefore, we summarily affirm under N.D.R.App.P. 35.1(a)(1). Costs are awarded to the appellee under N.D.R.App.P. 38 and 39.
