State v. Stibbe
No. 990202
Per Curiam.
[¶1] Gary Arlen Stibbe appeals from a criminal judgment and commitment and jury verdict finding him guilty of theft. On appeal, Stibbe claims the district court erred in denying his motion for judgment of acquittal, and he claims there was insufficient evidence to support the jury's verdict. The record supports the jury's finding Stibbe knowingly took or exercised unauthorized control over, or made an unauthorized transfer of an interest in, the property of another with intent to deprive the owner thereof. See N.D.C.C. § 12.1-23-02(1).
[¶2] The judgment and conviction are affirmed under N.D.R.App.P. 35.1(a)(2) and (3).
