—[*1]In an action, inter alia, to recover a down payment in connection with the sale of real property, the defendant appeals, as limited by his brief, from so much of an order of the Supreme Court, Rockland County (Sherwood, J.), dated March 29, 2004, as, upon renewal and reargument, adhered to a prior determination in an order of the same court dated November 14, 2003, denying his motion for the imposition of costs and sanctions.

Ordered that the appeal is dismissed, without costs or disbursements.
