[*1]In re Diavonni G., A Dependent Child Under the Age of Eighteen Years,

and

Vanessa G., Respondent-Appellant, Administration for Children's Services, Petitioner-Respondent.

Geoffrey P. Berman, Larchmont, for appellant.
Michael A. Cardozo, Corporation Counsel, New York (Diana
Lawless of counsel), for respondent.
Karen Freedman, Lawyers for Children, New York (Betsy
Kramer of counsel), attorney for the child.

Order of disposition, Family Court, New York County (Susan Knipps, J.), entered on or about November 15, 2011, which, on motion of the attorney for the child, modified a prior order of disposition and placed the subject child in the custody of the Commissioner of Social Services, unanimously affirmed, without costs.

The record evidence demonstrates that the continuation of the subject child in respondent mother's home is contrary to her best interests (Family Ct Act § 1061; Matter of Shinice H., 194 AD2d 444 [1st Dept 1993]).

THIS CONSTITUTES THE DECISION AND ORDER
OF THE SUPREME COURT, APPELLATE DIVISION, FIRST DEPARTMENT.
