People v Santos 2008 NY Slip Op 09444 [57 AD3d 215] December 2, 2008 Appellate Division, First Department Published by New York State Law Reporting Bureau pursuant to Judiciary Law § 431. As corrected through Wednesday, February 11, 2009

The People of the State of New York, Respondent,
v
Regina Santos, Appellant.

—[*1] Steven Banks, The Legal Aid Society, New York (Steven Berko of counsel), for appellant.

Robert M. Morgenthau, District Attorney, New York (Lucy Jane Lang of counsel), for respondent.

Judgment, Supreme Court, New York County (Richard D. Carruthers, J.), entered July 17, 2006, convicting defendant, after a jury trial, of insurance fraud in the third degree and falsifying business records in the first degree, and sentencing her to a term of five years' probation and a $5,000 fine, unanimously affirmed.

The jury's verdict was not against the weight of the evidence (see People v Danielson, 9 NY3d 342, 348-349 [2007]). Defendant's guilt was established by the testimony of multiple witnesses, and we find no basis for disturbing the jury's decision to credit those witnesses. Concur—Mazzarelli, J.P., Saxe, Catterson, Renwick and Freedman, JJ.
