Order, Supreme Court, New York County (Edward J. McLaughlin, J.), entered on or about March 23, 2004, which denied defendant's CPL 440.10 motion to vacate a judgment of the same court (William Leibovitz, J.), rendered February 18, 1998, convicting him, after a jury trial, of rape in the first degree and sexual abuse in the first degree, unanimously affirmed.

The court properly denied defendant's motion without a hearing. Defendant offered no evidence that a witness at his trial received any promise or understanding regarding lenient treatment in his unrelated Bronx case.
