______________________________________
Submitted December 20, 2005 - Decided January 11, 2006
Before Judges Skillman and Axelrad.
On appeal from Division of Pension and Benefits, Department of the Treasury.
Dr. George Pieczenik, appellant, pro se.
Peter C. Harvey, Attorney General, attorney for respondent (Michael J. Haas, Assistant Attorney General, of counsel; David Dembe, Deputy Attorney General, on the brief).
PER CURIAM
Appellant George Pieczenik appeals from a final decision of the Director of the Division of Pensions and Benefits, dated May 9, 2005, which denied his request to receive an in-service distribution of mandatory employer and employee contributions, plus any gains resulting from investment performance, from his retirement account under the Alternate Benefit Program. We affirm substantially for the reasons set forth in the Director's final decision.
Affirmed.
