Electronic Document Nov 10 2022 16:30:36 89-R-99012-SCT Pages: 2 Serial: 244023 IN THE SUPREME COURT OF MISSISSIPPI No. 89-R-99012-SCT IN RE: RULES GOVERNING ADMISSION TO THE MISSISSIPPI BAR EN BANC ORDER The following petitions are before the Court: The Petition to Amend the Rules Governing Admission to the Mississippi Bar filed by the Mississippi Board of Bar Admissions on May 6, 2022; The Petition to Amend Rule IV §8 of the Rules Governing Admission to the Mississippi Bar filed by Jefferson Carl Harvey on April 21, 2022; The Emergency Petition to Amend Rule IV Section 8 of the Rules Governing Admission to the Mississippi Bar filed by Applicant 11596 on June 25, 2021; and The Petition for Ruling Regarding Motion #2022-1321 A/K/A “Petition to Amend the Rules Governing Admission to the Mississippi Bar” filed by Jefferson Carl Harvey on October 31, 2022. After due consideration, the Court finds the Mississippi Board of Bar Admissions’ petition should be granted as set forth in Exhibit A. The Court further finds the petitions filed by Jefferson Carl Harvey on April 21, 2022, and Applicant 11596 on June 25, 2021, should be denied. Last, the Court finds the Petition for Ruling Regarding Motion #2022-1321 A/K/A “Petition to Amend the Rules Governing Admission to the Mississippi Bar” filed by Jefferson Carl Harvey on October 31, 2022, should be dismissed. IT IS THEREFORE ORDERED that the Petition to Amend the Rules Governing Admission to the Mississippi Bar filed by the Mississippi Board of Bar Admissions is hereby granted as set forth in Exhibit A. These amendments apply to applications for and subsequent to the February 2023, Mississippi Bar Examination. IT IS FURTHER ORDERED that the Petition to Amend Rule IV §8 of the Rules Governing Admission to the Mississippi Bar filed by Jefferson Carl Harvey on April 21, 2022, and the Emergency Petition to Amend Rule IV Section 8 of the Rules Governing Admission to the Mississippi Bar filed by Applicant 11596 on June 25, 2021, are hereby denied. IT IS FURTHER ORDERED that the Petition for Ruling Regarding Motion #2022-1321 A/K/A “Petition to Amend the Rules Governing Admission to the Mississippi Bar” filed by Jefferson Carl Harvey on October 31, 2022, is hereby dismissed. IT IS FURTHER ORDERED that the Clerk of this Court shall spread this Order upon the minutes of the Court and shall forward a true certified copy hereof to West Publishing Company for publication in the next edition of the Mississippi Rules of Court and in the Southern Reporter, Third Series, (Mississippi Edition). SO ORDERED. ALL JUSTICES AGREE. 2 EXHIBIT A RULE IV. EXAMINATION APPLICATIONS. **** Section 8. Re-Examination in Excess of Four Prohibited. An applicant who has unsuccessfully taken the Mississippi Bar Exam at least four (4) times shall not be eligible for re-examination.
