If this opinion indicates that it is “FOR PUBLICATION,” it is subject to revision until final publication in the Michigan Appeals Reports. STATE OF MICHIGAN COURT OF APPEALS PEOPLE OF THE STATE OF MICHIGAN, UNPUBLISHED November 23, 2021 Plaintiff-Appellee, v No. 354280 Eaton Circuit Court LC No. 18-020012-FH HENRY ALBERT MOORE JR., Defendant-Appellant. Before: RICK, P.J., and RONAYNE KRAUSE and LETICA, JJ. RICK, J. (concurring). I write to concur in the result only. While the trial court’s close friend (whom the court referenced at the defendant’s probation violation hearing) may not have come home from war with significant mental health wounds, defendant did. It is not a personal failing. It is, tragically, a price paid by many men and women in uniform, particularly those who fought on the front lines in Afghanistan and Iraq. See American Addiction Center, Alcohol Abuse Among Veterans, https://americanaddictioncenters.org/alcoholism-treatment/alcoholism-among-veterans (findings include (a) that increased exposure to trauma, violence, and combat increases military personnel’s risk of problematic drinking, and veterans diagnosed with PTSD and alcoholism are more likely to binge drink, and (b) the Substance Abuse and Mental Health Services Administration (SAMSHA) estimates that between 37 and 50 percent of Afghanistan and Iraq War veterans are diagnosed with some form of mental health condition)(accessed October 22, 2021). This in no way excuses assaultive conduct. However, it offers a glimpse into the complexity and magnitude that traumatic experiences can have on those whose trauma goes untreated. See Van der Kolk, The Body Keeps the Score: Brain, Mind, and Body in the Healing of Trauma (New York: Penguin Publishing Group, 2015). /s/ Michelle M. Rick -1-
