RIORDAN, J. (concurring) I concur with the result reached by the majority. However, we need not consider Crawford v Washington, 541 US 36; 124 S Ct 1354; 158 L Ed 2d 177 (2004), in reaching our decision. Our Supreme Court has long held that courts should not grapple with finding a constitutional question when the case can be decided on other grounds. People v Jackson, 487 Mich 783, 801; 790 NW2d 340 (2010). Any analysis of the constitutional implications of Crawford is not necessary for the disposition of this matter. /s/ Michael J. Riordan -1-
