No. 303424 Wayne Circuit Court Family Division LC No. 06-453289 Before: MURPHY, C.J., and BECKERING and RONAYNE KRAUSE, JJ. MEMORANDUM. Respondent appeals as of right from the termination of her parental rights to the minor child pursuant to MCL 712A.19b(3)(b)(i), (g), (i), and (j). We affirm. The trial court did not clearly err in finding the statutory grounds for termination of respondent s parental rights were established by clear and convincing evidence. MCR 3.977(K); In re Mason, 486 Mich 142, 152, 782 NW2d 747 (2010); In re Trejo, 462 Mich 341, 356-357, 612 NW2d 407 (2000). Respondent admitted using crack cocaine during her pregnancy and both she and the child tested positive for cocaine on the date of the child s birth. Given that respondent-mother was not in any substance abuse program, had been using crack cocaine since 2005, and had given birth to two other children who tested positive for cocaine, it was not clear error for the court to find that there was a reasonable likelihood that A. King would suffer injury if returned to respondent s care. Respondent also admitted that she did not have proper provisions, housing, or income to provide proper care for this child. She acknowledged that her parental rights to two of her six other children were terminated and that she had received no prenatal care until the last three weeks of this pregnancy. She continued to use cocaine despite the loss of her parental rights regarding two prior children, demonstrating that prior attempts to rehabilitate her were unsuccessful. We find no error in the trial court s determination that MCL 712A.19b(3)(b)(i), (g), (i), and (j) were established. -1- Moreover, we find no clear error in the trial court s finding that termination of respondent s parental rights was in the child s best interests.
