K. F. KELLY, J. (Concurring.)
I agree with the lead opinion’s statement that “in cases of both bribery and extortion, a
person’s payment of money operates to the detriment of the public interest, which is all that
Michigan law demands for declaring a contract unenforceable as against public policy based on
criminal conduct.” I further agree that the trial court prematurely granted defendant’s motions
for summary disposition. Thus, I concur in reversing and remanding these cases for further
proceedings.
