STATE OF MICHIGAN COURT OF APPEALS In the Matter of RUNA-ANN JADE WEIRAUCHPOWELL, Minor. DEPARTMENT OF HUMAN SERVICES, UNPUBLISHED November 16, 2006 Petitioner-Appellee, V No. 269241 St. Clair Circuit Court Family Division LC No. 06-000034-NA SAMANTHA ANN WEIRAUCH, Respondent-Appellant. Before: White, P.J. and Zahra and Kelly, JJ. MEMORANDUM. Respondent appeals of right the trial court’s order terminating her parental rights to the minor child pursuant to MCL 712A.19b(3)(g), (i), (j), and (l). We affirm. This appeal is being decided without oral argument pursuant to MCR 7.214(E). The trial court did not clearly err in finding that at least one statutory ground for termination had been proven by clear and convincing evidence. In re IEM, 233 Mich App 438, 450; 592 NW2d 751 (1999). The evidence clearly established that respondent’s parental rights to another child were previously terminated after the initiation of neglect proceedings under MCL 712A.2(b), and that attempts to rehabilitate respondent were unsuccessful after her prior child became a court ward. MCL 712A.19b(3)(i) and (l). Further, the trial court’s finding regarding the child’s best interests was not clearly erroneous. In re Trejo, 462 Mich 341, 354, 356-357; 612 NW2d 407 (2000); MCL 712A.19b(5). Thus, the court did not err in terminating respondent’s parental rights to the child. Affirmed. /s/ Helene N. White /s/ Brian K. Zahra /s/ Kirsten Frank Kelly -1-
