STATE OF MICHIGAN COURT OF APPEALS In the Matter of ASIA NADIA JACKSON, D’MARKO CURAN JACKSON, and ALISHA ANN JACKSON, Minors. FAMILY INDEPENDENCE AGENCY, UNPUBLISHED September 29, 2005 Petitioner-Appellee, v No. 258730 Macomb Circuit Court Family Division LC No. 03-054098-NA D’MARKO CURAN JEFFERSON, Respondent-Appellant. Before: Bandstra, P.J., and Neff and Donofrio, JJ. MEMORANDUM. Respondent appeals as of right the trial court order terminating his parental rights to the minor children under MCL 712A.19b(3)(b)(i), (g), and (j). We affirm. After a review of the record, we conclude that the trial court did not clearly err in finding that the statutory grounds for termination were established by clear and convincing evidence. MCR 3.977(J); In re Miller, 433 Mich 331, 337; 445 NW2d 161 (1989). The evidence that respondent’s youngest daughter was severely neglected, that respondent had pleaded guilty to attempted second-degree child abuse for this neglect, that respondent had taken no steps to resolve his substance abuse problem, and that respondent made no progress on his case treatment plan supports the trial court’s findings. Furthermore, the evidence did not show that termination of respondent’s parental rights was clearly not in the children’s best interests. MCL 712A.19b(5); In re Trejo Minors, 462 Mich 341, 356-357; 612 NW2d 407 (2000). We affirm. /s/ Richard A. Bandstra /s/ Janet T. Neff /s/ Pat M. Donofrio -1-
