I concur with the majority opinion because I believe that any error resulting from defense counsel’s quotation of a Court of Appeals opinion was harmless under the circumstances of this case. I write separately, however, to discourage any practice of quoting from court opinions during closing argument. Quoting from such opinions could easily mislead a jury and undermine the jury instructions that the jurors are to utilize in deciding a matter. /s/ E. Thomas Fitzgerald -1-
