WHITE, J. (concurring).
I concur in the reversal. Plaintiff was required to obtain a special use permit
notwithstanding that the property had at an earlier time been operated as a gas station, which use
had been discontinued before plaintiff purchased the property. And, as the majority observes,
defendant’s actions did not create an estoppel against its enforcement of the special use permit
requirement.
