STATE OF MICHIGAN
COURT OF APPEALS
STATE FARM MUTUAL AUTOMOBILE
INSURANCE COMPANY,
UNPUBLISHED
May 4, 2001
Plaintiff-Appellee,
v
No. 218225
Lenawee Circuit Court
LC No. 97-007719-CK
VICTORIA JOHNSON,
Defendant-Appellant.
Before: Saad, P.J., and White and Hoekstra, JJ.
SAAD, P.J. (dissenting).
I respectfully dissent. Because any sensible definition of a public road clearly does not
include a privately-owned gas station which is neither public nor a road, I dissent from the
majority’s opinion. Leski v State Farm Mutual Auto Ins Co, 367 Mich 560; 116 NW2d 718
(1962), neither mandates nor warrants the result reached by the majority.
/s/ Henry William Saad
