STATE OF MICHIGAN COURT OF APPEALS PEOPLE OF THE STATE OF MICHIGAN, UNPUBLISHED August 8, 2000 Plaintiff-Appellee, v SHEILA M. GAVAL, No. 214185 Oakland Circuit Court LC No. 98-158037-FC Defendant-Appellant. Before: Murphy, P.J., and Kelly and Talbot, JJ. MEMORANDUM. Defendant was convicted by a jury of unarmed robbery, MCL 750.530; MSA 28.798, and sentenced as an habitual offender, fourth-offense, MCL 769.12; MSA 28.1084, to serve two to twenty years in prison. She appeals as of right, and we affirm. This appeal is being decided without oral argument pursuant to MCR 7.214(E). Defendant argues on appeal that the trial court’s supplemental instructions to the deadlocked jury and the failure to respond to the jury’s request for certain testimony to be reread resulted in a compromise verdict. Because defendant’s trial counsel expressed approval of the trial court’s handling of these matters, defendant has waived objection to any error in this regard. People v Carter, ___ Mich ___; ___ NW2d ___ (No. 113817, issued 6/27/00), slip op pp 10, 15-16; People v Hardin, 421 Mich 296, 322-323; 365 NW2d 101 (1984). To hold otherwise would allow defendant to harbor error as an appellate parachute. Carter, supra, slip op at 9; Hardin, supra at 322. Affirmed. /s/ William B. Murphy /s/ Michael J. Kelly /s/ Michael J. Talbot
