STATE OF MICHIGAN COURT OF APPEALS In the Matter of DEMETRICE GRIFFIN, Minor. FAMILY INDEPENDENCE AGENCY, UNPUBLISHED July 21, 2000 Petitioner -Appellee, v No. 224282 Jackson Circuit Court Juvenile Division LC No. 97-019579-NA SHARON GLASPIE, Respondent -Appellant, and JESSE GRIFFIN, Respondent. Before: Saad, PJ, and Hoekstra and Markey, JJ PER CURIAM. Respondent-appellant appeals by right from the juvenile court order terminating her parental rights to the minor child under MCL 712A.19b(3)(c)(i), (g), and (j); MSA 27A.3178(598.19b)(3)(c)(i), (g), and (j). We affirm. We find from a review of the record that the trial court did not clearly err in finding that each of the above-referenced subsections was established by clear and convincing evidence. MCR 5.974(I); In re Vasquez, 199 Mich App 44, 51; 501 NW2d 231 (1993). The record shows that although respondent participated in rehabilitation programs, her substance abuse continued. She did not follow through with services offered to address her substance abuse and the child’s medical condition. She failed to attend the majority of scheduled appointments or home visits. She did not take advantage of a weekly home visit and weekly play group where physical therapy, occupational therapy and a teacher were available. Further, the record demonstrates that respondent remains unavailable, that is she cannot -1 provide an address other than the father’s or her mother’s, and both of those individuals maintain that she does not reside with them. Furthermore, respondent made no progress with respect to substance abuse treatment, she cannot care for herself or the child, and she is unavailable most of the time because of her incarceration. Because respondent-appellant failed to present evidence that termination was clearly not in the child’s best interests, MCL 712A.19b(5); MSA 27.3178(598.19b)(5), the court did not err in terminating her parental rights to the child. In re Trejo, ___ Mich ___; ___ NW2d ___ (2000). Affirmed. /s/ Henry William Saad /s/ Joel P. Hoekstra /s/ Jane E. Markey -2
