STATE OF MICHIGAN
COURT OF APPEALS
In the Matter of CHARLES J. SMITH, JOHN
HATZENBUHLER and ERIC WILLIAM LENART,
Minors.
FAMILY INDEPENDENCE AGENCY,
UNPUBLISHED
March 27, 1998
Petitioner-Appellee,
v
No. 203645
Wayne Juvenile Court
LC No. 94-322170
TISHA SMITH and ERIC LENART,
Respondents-Appellants,
and
JOHN HATZENBUHLER,
Respondent.
Before: Fitzgerald, P.J., and Hood and Sawyer, JJ.
MEMORANDUM.
Respondent Smith appeals as of right from the juvenile court order terminating her parental
rights to the three minor children under MCL 712A.19b(3)(a)(ii), (b)(i), (c)(i), (g) and (j); MSA
27.3178(598.19b)(3)(a)(ii), (b)(i), (c)(i), (g) and (j). Respondent Lenart also appeals as of right from
the juvenile court order which terminated his parental rights to the minor Eric William Lenart on the
same statutory grounds. We affirm.
There was clear and convincing evidence to support the statutory grounds for terminating
respondents’ parental rights. In re Miller, 433 Mich 331, 337; 445 NW2d 161 (1989); In re
Jackson, 199 Mich App 22, 25; 501 NW2d 182 (1993). Moreover, respondents did not show that
retaining their parental rights was in the best interests of the children. Thus, the juvenile court’s decision
-1
to terminate those rights was not clearly erroneous. MCL 712A.19b(5); MSA 27.3178(598.19b)(5);
In re Hall-Smith, 222 Mich App 470, 472; 564 NW2d 156 (1997).
Affirmed.
