STATE OF MICHIGAN
COURT OF APPEALS
PEOPLE OF THE STATE OF MICHIGAN,
UNPUBLISHED
January 9, 1998
Plaintiff-Appellee,
v
No. 196127
Ottawa Circuit Court
LC No. 95-018963 FH
KEVIN JOE SHELTON,
Defendant-Appellant.
Before: MacKenzie, P.J., and Hood and Hoekstra, JJ.
MEMORANDUM.
Defendant appeals by leave granted from his plea of guilty to attempted unlawful driving away of
an automobile, MCL 750.413; MSA 28.645. On appeal, defendant challenges the proportionality of
his twenty- to thirty-month sentence as a departure from the sentencing guidelines. Because defendant
has already served his minimum sentence, we decline to review this issue. Where a subsequent event
renders it impossible for this Court to fashion a remedy, an issue becomes moot. People v Rutherford,
208 Mich App 198, 204; 526 NW2d 620 (1994).
Affirmed.
/s/ Barbara B. MacKenzie
/s/ Harold Hood
/s/ Joel P. Hoekstra
