STATE OF MICHIGAN COURT OF APPEALS In the Matter of the Estate of NELLIE E. STUDDARD, Deceased. _________________________________________ UNPUBLISHED August 22, 1997 SUSAN LEWIS, Personal Representative of the Estate of NELLIE E. STUDDARD, Deceased, Appellee, v JAMES F. STUDDARD, Administrator of the Estate of JAMES W. STUDDARD, Deceased, No. 196267 Presque Isle Probate Court LC No. 94-006769-IE Appellant. Before: Sawyer, P.J., and Bandstra and E. A. Quinnell*, JJ. MEMORANDUM. Appellant appeals by right a June 26, 1996, order of the Presque Isle Probate Court, granting appellee’s motion to permit collection of attorney fees and costs awarded by order of May 14, 1996, from a security for costs bond previously filed by appellant. No appeal was ever taken from the order of May 14, 1996, granting appellee’s motion for costs and attorney fees in the amount of $6,500. Yet the issues raised on this appeal concern the propriety of that May 14, 1996, order. As the order of May 14, 1996, was appealable, MCR 5.801(B)(3)(u), this appeal from a subsequent order is therefore limited only to issues related to the order from which appeal has been claimed. People v Pickett, 391 Mich 305, 316-317; 215 NW2d 695 (1974). As this Court is without jurisdiction, therefore, to adjudicate the issues presented, this appeal is dismissed. Dismissed. * Circuit judge, sitting on the Court of Appeals by assignment. -1 /s/ David H. Sawyer /s/ Richard A. Bandstra /s/ Edward A. Quinnell -2
