COURT OF APPEALS
PEOPLE OF THE STATE OF MICHIGAN,
UNPUBLISHED
September 27, 1996
Plaintiff-Appellee,
v
No. 184003
LC No. 93-062413-FH
ROBERT LEE BOYD,
Defendant-Appellant.
Before: J.H. Gillis, P.J., and G.S. Allen and J.B. Sullivan, JJ.*
MEMORANDUM.
Defendant pleaded guilty to violating probation on his underlying conviction of unarmed
robbery, MCL 750.530; MSA 28.798, and was sentenced to 2-1/2 to 15 years’ imprisonment. He
appeals as of right. We affirm. This case has been decided without oral argument pursuant to MCR
7.214(A).
Defendant’s sentence does not violate the principle of proportionality considering the
seriousness of the underlying offense, his juvenile criminal history, and his repeated failure to take
advantage of leniency and rehabilitative opportunities. People v Milbourn, 435 Mich 630, 636, 650
651; 461 NW2d 1 (1990).
Affirmed.
/s/ John H. Gillis
/s/ Glenn S. Allen, Jr.
/s/ Joseph B. Sullivan
