Court of Appeals, State of Michigan ORDER Michelle M. Rick Presiding Judge In re J V Locricchio Minor Docket No. 359738 Colleen A. O’Brien LC No. 2019-000270-NA Sima G. Patel Judges The motion for reconsideration is GRANTED, and this Court’s opinion issued November 3, 2022 is hereby VACATED. This matter will be rebriefed and submitted to a new panel for decision. This cause is REMANDED to the trial court for the appointment of appellate counsel for the respondent-appellee, Cory Trevor. MCR 6.425(G)(1). Matters pertaining to the appointment of an attorney are decided in the trial court. MCR 7.208(H). The trial court shall appoint counsel for respondent-appellee within 14 days of this order. The trial court shall send a copy of the order of appointment to the Clerk of this Court within 7 days of the decision. On the Court’s own motion, the petitioner-appellant’s brief filed on March 8, 2022 is considered withdrawn. Petitioner-appellant’s time for filing a new brief on appeal shall run from the date of the trial court’s order appointing counsel to represent respondent-appellee Trevor. The time for filing respondent-appellee’s brief shall run from the date of service of petitioner-appellant’s brief. The Clerk’s Office is directed to email a copy of this order to Judge Teri Lynn Dennings, Macomb County Juvenile Court.
