ARNOLD CRABTREE * NO. 2002-CA-0612 VERSUS * COURT OF APPEAL THE ESTATE OF HSIANG LIU KUO, ALLSTATE INSURANCE COMPANY AND CANAL INDEMNITY INSURANCE COMPANY * FOURTH CIRCUIT * STATE OF LOUISIANA * * ******* Armstrong, J., dissents. I respectfully dissent. The trial court should have the opportunity to review Mr. Crabtree’s medical records as to the issue of whether he has proven damages. That is particularly so because Mr. Crabtree’s $7,861.23 in medical expenses lend credence to his allegations of injury. I would remand for a new trial so that the trial court can consider Mr. Crabtree’s medical records along with any other pertinent evidence.
