STATE OF LOUISIANA * NO. 2000-KA-0302 VERSUS * COURT OF APPEAL DARRELL JOHNSON * FOURTH CIRCUIT * STATE OF LOUISIANA * * ******* JONES, J., CONCURS IN PART AND DISSENTS IN PART While I agree with the majority that Johnson's conviction should be affirmed, I completely disagree that his sentence of life imprisonment is not excessive. Given the history of Johnson, that he clearly is a user, I cannot see how the citizens of this State are better served by incarcerating him for the rest of his life, while the actual seller of the drugs in the case sub judice receives a much lesser sentence. Thus, I respectfully Dissent.
