Defendant Steven Spears was convicted by jury of murder and several related crimes, all in connection with the 2001 death of Sherri Holland. Finding two aggravating circumstances, the jury recommended the death penalty. Defendant appealed raising several issues as grounds to overturn the conviction and sentence. After careful consideration of those arguments in its review of the trial court record, the Supreme Court affirmed the convictions and sentence, but vacated the merger of two burglary counts. The case was remanded for recalculation of an appropriate sentence for a burglary charge for which defendant had not yet been sentenced.
