As the facts of the case are similar to Long v. Swofford, 805 So. 2d 882 (Fla. 3d DCA 2001); see also O Vahey v. Miller, 644 So. 2d 550 (Fla. 3d DCA 1994), we conclude that the trial court acted within its discretion in dismissing the case. Affirmed. 2
