Contrary to the position of the State, there is a double jeopardy issue. See Cleveland v. State, 587 So. 2d 1145 (Fla. 1991); Weiss v. State, 720 So. 2d 1113 (Fla. 3d DCA 1998), approved, 761 So. 2d 318 (Fla. 2000). The effect defendant s plea was to waive the double jeopardy issue. v. State, 634 So. 2d 607 (Fla. 1994). of the Novaton Defendant contends that his trial counsel was ineffective for failing to raise the double jeopardy issue. Even after eliminating the duplicate offenses, defendant was exposed to a life sentence as a habitual offender. Alternatively, based on the fact that the defendant committed his crime after October 1, 1998, the defendant was also exposed to a life term if he had been sentenced under the guidelines. That is so because under the revised guidelines, the court would be free to impose any sentence up to the legal maximum, which was life imprisonment, without giving an upward departure reason. ยงยง 921.0021 et seq., Fla. Stat. (1997).
