FIRST DISTRICT COURT OF APPEAL STATE OF FLORIDA _____________________________ No. 1D20-1772 _____________________________ THOMAS A. SOSNOWSKI, Appellant, v. STATE OF FLORIDA, Appellee. _____________________________ On appeal from the Circuit Court for Santa Rosa County. J. Scott Duncan, Judge. August 19, 2020 PER CURIAM. The trial court filed its order denying Mr. Sosnowski’s postconviction motion on April 28, 2020. Mr. Sosnowski had 30 days from that date to file a notice of appeal, but he presumptively filed his notice of appeal on June 1, 2020, when he gave his notice to prison officials. See Fla. R. App. P. 9.420(a)(2)(A) (providing for presumption that an inmate has filed a document “on the date the inmate places it in the hands of” a corrections official). After reviewing Mr. Sosnowski’s response to our show cause order, we DISMISS this appeal as untimely. ROBERTS, NORDBY, and TANENBAUM, JJ., concur. _____________________________ Not final until disposition of any timely and authorized motion under Fla. R. App. P. 9.330 or 9.331. _____________________________ Thomas A. Sosnowski, pro se, Appellant. Ashley Moody, Attorney General, Tallahassee, for Appellee. 2
