IN THE DISTRICT COURT OF APPEAL FIRST DISTRICT, STATE OF FLORIDA LOUIS VEGA, NOT FINAL UNTIL TIME EXPIRES TO FILE MOTION FOR REHEARING AND DISPOSITION THEREOF IF FILED Appellant, v. CASE NO. 1D03-2642 GLENN AND SHITAMA, CELESTE Appellee. ___________________________/ Opinion filed August 14, 2003. An appeal from the Circuit Court for Alachua County. Chester B. Chance, Judge. Appellant, pro se. Christopher J. Nicholas, Tallahassee, for Appellee. PER CURIAM. The Court has determined that because the appellant s motion for rehearing was not timely served, it did not delay rendition of the final judgment. See Fla. R. Civ. P. 1.530; Fla. R. App. P. 9.020(h). Consequently, the appellant s notice of appeal was not timely filed and this Court lacks jurisdiction to review the order on appeal. Accordingly, the appeal is hereby dismissed. DISMISSED. ERVIN, BARFIELD and DAVIS, JJ., CONCUR.
