IN THE DISTRICT COURT OF APPEAL OF THE STATE OF FLORIDA FIFTH DISTRICT NOT FINAL UNTIL TIME EXPIRES TO FILE MOTION FOR REHEARING AND DISPOSITION THEREOF IF FILED BRIAN P. BALUT, Appellant, v. Case No. 5D20-1973 KATHLEEN C. BALUT, Appellee. ________________________________/ Opinion filed January 15, 2021 Nonfinal Appeal from the Circuit Court for Lake County, Brian Welke, Judge. Christopher M. Sprysenski, of The Florida Family Firm, Altamonte Springs, for Appellant. John J. Vasti, of Vasti Law, P.A., Tavares, for Appellee. PER CURIAM. Brian P. Balut appeals the trial court’s nonfinal order granting his wife’s, Kathleen C. Balut, motion for an interim partial equitable distribution of the parties’ marital assets. 1 The order provides that each party is to receive a distribution of “up to $250,000” but that, 1 See § 61.075(5), Fla. Stat. (2019). absent agreement between the parties as to the source of the distribution, an additional hearing shall be scheduled “to determine the assets and amounts to be distributed.” Our record does not show that the parties have reached the aforementioned agreement. Accordingly, because it appears that the circuit court’s judicial labor on the motion has not yet been completed, we dismiss the appeal. APPEAL DISMISSED. EVANDER, C.J., LAMBERT and TRAVER, JJ., concur. 2
