IN THE DISTRICT COURT OF APPEAL OF THE STATE OF FLORIDA FIFTH DISTRICT JANUARY TERM 2013 NOT FINAL UNTIL TIME EXPIRES TO FILE MOTION FOR REHEARING AND DISPOSITION THEREOF IF FILED STATE OF FLORIDA, Petitioner, v. Case No. 5D12-2409 ALAN RAY PAULK, Respondent. ________________________________/ Opinion filed February 15, 2013 Petition for Certiorari Review of Order from Circuit Court for Citrus County, Richard A. Howard, Judge. Brad King, State Attorney, and Brian Trehy, Assistant State Attorney, of Fifth Judicial Circuit, Inverness, for Petitioner. Michael R. Buchanan, of Dethomasis & Buchanan, P.A., Gainesville, for Respondent PER CURIAM. Petitioner, State of Florida, seeks certiorari review of an order rendered on June 14, 2012, requiring the State to produce certain materials that the State alleges will result in material harm if disclosed. Having thoroughly reviewed the record, we conclude that the order under review departs from the essential requirements of the law and results in material injustice. See State v. Pettis, 520 So. 2d 250 (Fla. 1988). We therefore quash the order under review and remand this case for further proceedings. PETITION GRANTED; ORDER QUASHED; REMANDED. SAWAYA, EVANDER and JACOBUS, JJ., concur.
