Whitman appeals the dismissal of his 28 U.S.C. § 2241 petition for a writ of habeas corpus. While this case was on appeal before this Court, the Supreme Court decided a potentially dispositive case, Borden v. United States, 141 S. Ct. 1817 (2021). Further, in Allen v. Both parties now raise arguments that were not before the district court. We therefore vacate and remand the dismissal of Whitman’s petition on an open record.
